EU and Czech Regulations on Foreign Residence

The residence of foreigners on the territory of the Czech Republic is governed by Act No. 326/1999 Coll., on the Residence of Foreigner Nationals in Czech Republic and on the Amendment of Certain Acts, as amended (hereinafter referred to as the Foreigners Act). The current wording of the Foreigners Act and related amendments is available on the website of the Ministry of the Interior.

The residence of foreigners on the territory of the Czech Republic is further governed by the legal regulations of the European Union (EU) and the European Community (EC). In the visa area, this primarily concerns Regulation (EC) of the European Parliament and of the Council No. 810/2009 establishing a Community Code on Visas (Visa Code) and Regulation (EC) No. 539/2001 (as amended) listing the third countries whose nationals must be in possession of a visa when crossing the external borders and those whose nationals are exempt from that requirement.

All regulations of the Schengen acquis have been applicable in the Czech Republic since 21 December 2007, when the Czech Republic became part of the Schengen Area. More information is available on the websites of the relevant ministries: www.mvcr.cz and www.mzv.gov.cz.
